1. Acceptance of Terms
By accessing or using TAD Delivery Intelligence (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to all terms and conditions herein, you may not use the Service. The Agility Doctor, Inc. (the "Company," "we," "us," or "our") offers the Service subject to these terms.
By creating an account or using the Service on behalf of a company or organization, you represent and warrant that you have authority to bind that entity to these terms.
2. Service Description
TAD Delivery Intelligence is a diagnostic platform that evaluates engineering delivery systems. The Service analyzes delivery performance across six scored dimensions: flow efficiency, WIP discipline, throughput, intake quality, team structure, and delivery visibility. It includes two analytical layers: data confidence and SLE integrity assessment.
The Service is offered in three pricing tiers:
- Lite (Free): A directional diagnostic assessment for a single team or cross-functional group.
- Plus ($497): Extended assessment covering multiple teams or broader organizational scope with deeper analysis.
- Pro ($2,497): Comprehensive department-level diagnostic with full analytical depth, trend analysis, and strategic recommendations.
Pricing is subject to change with 30 days' notice. All prices are in United States Dollars (USD).
3. Account and Access
Token-Based Access
Access to your diagnostic assessment is granted through a unique access token. This token is personal and non-transferable. You are responsible for maintaining the confidentiality of your access token. Do not share your token with unauthorized parties. Each token grants access to your specific assessment only.
Admin Access
Our team maintains administrative access to the platform for the purposes of:
- Processing and delivering diagnostic assessments
- Reviewing submitted data for accuracy and completeness
- Generating diagnostic reports and recommendations
- Maintaining, supporting, and improving the Service
Account Responsibility
You are responsible for all activity that occurs under your token or account. You agree to notify us immediately of any unauthorized access or use. We are not responsible for any loss or damage arising from unauthorized access to your account.
4. Payment Terms
Payment Processing
Payments for Plus and Pro tiers are processed through Stripe. By providing payment information, you authorize us to charge your payment method. All prices are listed in United States Dollars (USD).
Refund Policy
Refunds are available under the following conditions:
- Prior to Diagnostic Delivery: If your diagnostic assessment has not yet been completed and delivered, you may request a full refund within 14 days of payment.
- After Diagnostic Delivery: No refunds are available once your diagnostic assessment has been delivered, regardless of satisfaction or outcomes.

5. Intellectual Property
TAD Methodology and Algorithms
The TAD diagnostic methodology, including all scoring algorithms, assessment frameworks, and analytical models, are proprietary intellectual property owned by The Agility Doctor, Inc. These methodologies are protected by copyright and other intellectual property laws. You may not reverse engineer, deconstruct, or attempt to derive the methodology underlying the Service.
Report Formats and Content
The format, structure, presentation, and analysis of diagnostic reports generated by the Service are proprietary works owned by The Agility Doctor, Inc. You may use your diagnostic reports for internal business purposes only. You may not reproduce, distribute, publicly display, or create derivative works based on these reports without express written permission.
Client Data Ownership
You retain all rights to the data you submit to the Service. However, by submitting data for assessment, you grant The Agility Doctor, Inc. a non-exclusive license to use your data for the purposes of delivering the diagnostic assessment, improving the Service, and conducting aggregate research. This research will not identify you individually or reveal your confidential information.
6. Acceptable Use Policy
You agree not to use the Service in violation of any law, regulation, or these terms. Specifically, you agree not to:
- Reverse Engineer or Deconstruct: Attempt to reverse engineer, decompile, disassemble, or otherwise derive the methodology, algorithms, or proprietary systems underlying the Service.
- Automated Scraping: Use bots, scrapers, automated systems, or scripts to extract, copy, or collect data from the Service without express permission.
- Share Access Tokens: Share, sell, trade, or transfer your access token to any unauthorized third party. Tokens are personal and non-transferable.
- Unauthorized Commercial Use: Use the Service to create competing products, services, or offerings based on the TAD methodology.
- Circumvent Security: Attempt to bypass, circumvent, or disable any security features or restrictions of the Service.
- Disruptive Conduct: Engage in any behavior that disrupts, damages, or impairs the functionality or availability of the Service.
Violation of these acceptable use policies may result in immediate suspension or termination of your access, at our sole discretion.
7. Limitation of Liability
Advisory Nature of Diagnostics
TAD diagnostic assessments are advisory in nature. They provide insights, analysis, and recommendations based on the data you provide and the TAD methodology. However, diagnostics are not guarantees of business outcomes, delivery improvements, or organizational success. The effectiveness of the Service depends on how your organization implements recommendations and the broader context of your business environment.
No Warranty
The Service is provided on an "as-is" basis. We make no warranties, express or implied, regarding the accuracy, completeness, or timeliness of diagnostic results. We do not warrant that the Service will be uninterrupted, error-free, or free from defects.
Limitation of Damages
To the maximum extent permitted by law, The Agility Doctor, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or business interruption, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.
8. Modifications to Terms
We reserve the right to modify these Terms of Service at any time. Material changes will be communicated via email or through the Service, with at least 30 days' notice. Your continued use of the Service following the posting of revised Terms means you accept and agree to the changes.
We may also modify or discontinue the Service (or any part thereof) at any time, with or without notice.
9. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any disputes arising out of or relating to these terms or the Service shall be subject to the exclusive jurisdiction of the federal and state courts located in the United States.
